NMN TV LIVE BRIEF KTA 6:Legal and Ethical considerations

Legal

PRS Licence- making sure this is in place so that musicians/record labels get paid royalties for songs that are broadcast. PRS Stands for Performing Rights Society. They work with the UK Government, parliament, The European commissions and European Parliament among with others to influence public policy and legislation. They pay royalties to their members when their work is performed, broadcast ,streamed, downloaded, reproduced, played in public Or used in film and TV. It ensures that the artists are getting paid. It is also important to the industry because it ensures that artists original content is protected and no outside parties profit from the work of others.

Copyright and ownership- if content is presented as original (this could also be use of imagery and graphics in backgrounds during presenter exposition). Copyright protects written, theatrical, musical and artistic work. Copyright will automatically cover any work you have created that is in a fixed form. If people want to use your original, copyrighted work, they would need to seek permission and it will often include a fee. Copyright ownership is when employees, contractors and freelancers sign an agreement which could be a non-disclosure form. This is important to the industry because outside parties will not be able to take credit for your work and/or profit from it.

Health and safety- when filming For camera Crew, presenters. There is legislation (by the law) I place to protect those in the media (why we also do recces, risk assessments) These measures are in place to to keep everyone safe. Before measures are put in place, crew members need to go on a recce and create a risk assessment of the working environment. The company should have a health and safety policy which lays out the procedures and any detailed risk assessment. These may be created for each scene, location, day, week, block or whole shoot depending on the timings and complexities involved. This is important to the industry because it ensures that the cast and crew remain safe during filming.

Contracts of works- model release, location release forms These Agreements cover the detail of working terms and conditions for the artist. These can be things such as numbers of performances, hours, breaks, health and safety, usage rights, royalties and touring. Equity offers a pension scheme which the actors then have the option to opt into. This then means that proper deductions are made out of the artists wage and the appropriate contributions are made to the schemes. This is important to the industry because it tells the artists what is needed from them.

Media regulation- music videos are regulated by the BBFC. This helps parents and children choose the most appropriate music videos. The BBFC is working with other key players in the industry to classify online videos and give them voluntary age ratings. All music videos by artists signed to UK music labels that are unsuitable for children under 12 will be classified with a BBFC age rating. This rating is displayed next to the video when it is published on YouTube. This is important to the industry as it ensures that children aren’t exposed to inappropriate materials.

Each Ethical Area:

  • Depiction of violence and sex/ Presence of strong language:
    • monitored by rating systems and supervised by agencies such as BBFC - music videos, OFCOM - broadcasting in general, ASA - advertising
  • "Fluff" or "Celebrity News":
    • when people who are not educated or mature enough believe the media outlets and completely trust them as facts
  • Product placement:
    • when producers in entertainment media are paid highly to include a brand/product, it is controversial and highly unregulated
  • Stereotypes in media representation:
    • advertising and entertainment media use stereotypes the most, they promote negative imagery about people's own image or encourage undesirable behaviour socially,
  • Women in media:
    • objectifying and de-humanising women's bodies, concept of female bodies being sold and owned becomes normal
  • Taste and taboo:
    • what kinds of moral values should be shown in entertainment media.
